Texting While Driving in Ohio

Bexley City Council members want motorists to keep both hands on the wheel, thumbs included.
The city is looking to be among the first central Ohio communities to ban texting while driving.

Councilman Jed Morison said he plans to propose a ban at tonight’s council meeting, although council members aren’t likely to vote on it until late September.

“It seems like kind of a common-sense sort of thing to do,” he said. “If there was a tragedy today, there would be a law tomorrow. I want to try to avoid that first tragedy. The key is to stay ahead of this technology.”

It isn’t clear whether the law also would cover browsing the Internet from a cell phone, but Morison said the council is targeting anything that involves typing.

Unlike Ohio’s seat belt law, it appears this texting legislation would be a primary offense- Which means police can pull you over simply for looking even slightly downward, under the suspicion of texting. I would have newfound respect for the ACLU if they took this case up, as it raises serious constitutional questions.
