The bill cleared the Senate on a 17-15 vote. Joining all Democrats in backing the bill were: Senate President Bill Harris (R-Ashland), Sen. John Carey (R-Wellston), Sen. David Goodman (R-New Albany), Sen. Tom Niehaus (R-New Richmond), and Sen. Mark Wagoner (R-Toledo).

The House later concurred 54-42, with Republican Rep. Matthew Dolan of Novelty and Rep. Ross McGregor of Springfield joining all Democrats in support.
